Isang resolusyon ang ibinasura ni Judge Recto

ng Metropolitan Trial Court Branch 13 - Manila,

matapos baliktarin ni Secretary of Justice Raul Gonzales ang resolusyon ng kanyang Undersecretary at katigan ang naunang resolusyon ng isang Manila City Fiscal na idismis ang isang kaso na dumating sa sala ni Judge Recto na may pamagat na PEOPLE OF THE PHILIPPINES VS LIZA KAO, et al, sa kasong Grave Coercion...

RESOLUSYON NI SEC. GONZALEZ

IBINASURA NI JUDGE RECTO

Isang resolusyon ang ibinasura ni Judge Recto ng Metropolitan Trial Court Branch 13 - Manila,matapos baliktarin ni Secretary of Justice Raul Gonzales ang resolusyon ng kanyang Undersecretary at katigan ang naunang resolusyon ng isang Manila City Fiscal na idismis ang isang kaso na dumating sa sala ni Judge Recto na may pamagat na PEOPLE OF THE PHILIPPINES VS LIZA KAO, et al, sa kasong Grave Coercion.

Hindi sinang-ayunan at kinuwestiyon ang motibo ni Justice Gonzales ng nabanggit na Huwes na nominado ulit bilang Outstanding Judge of the Philippines ng Korte Suprema sa bahagi ng kanyang ORDER na nilagdaan na may petsang Mayo 2, 2007.

"What makes this case interesting is, when the investigating City Prosecutor dismissed this case, the private complainant went to Secretary of Justice and the latter through Undersecretary Ernesto L. Pineda, reversed the resolution of the City Prosecutor of Manila and ordered the latter to file information of Grave Threats againts two accused. However, when a Motion for Reconsideration was filed, the motion was resolved not by said Undersecretary but by the Secretary of the Department of Justice, Raul Gonzales without any motion from the parties. The Seretary of Justice, motu propio took over the same and perhaps he does not believe in the resolution of his Undersecretary, he reversed the resolution, and ordered the City Prosecutor of Manla with leave of Court, the withdrawal of the Information for Grave Threats.

...still the Court is the final and ultimate judicial body to determine the existence of probable cause. The court is still capable of administering justice free from interference from any department of government." (Sec. 2 of Atr. 3 of the Constitution.)

Ang kaso ay sangkot ang pag-aaway ng isang pamilya ng mga instik sa pagmamay-ari ng Divisoria Mall sa Maynila kung saan pati ang opisina ng Malakanyang ay dinudulogan na ang kasong nabangit na nakabinbin ngayon sa sala ni Judge Recto upang iapila ang pagkatig sa naunaang resolusyon ni Justice Gonzales na hindi umobra kay Judge Recto kung kaya ay ibinasura ito.

Si Recto ay dating Romblon Board Member, former Provincial Attorney ng Administrasyon ni former Governor now RTC Judge Jose Madrid, former Barangay Captain's Attorney ng Maynila sa panunungkulan ng dating Manila Councilor Jojo F.
